NEET 2016: Order on medical admissions reserved by Bombay HC

In a recent development of the ongoing case about the National Eligibility and Entrance Test, NEET, the Bombay High Court has finally given its verdict. The issue was concerned about the domicile restrictions placed on NEET Maharashtra Moreover, the petitioners have also challenged the rules under the Maharashtra Unaided Private Professional Education Institution for NEET 2016.

As of now, the Bombay HC has reserved its order on the NEET Maharashtra issue. A division bench consisting of Chief Justice Manjula Chellur and Justice M.S. Sonak headed the whole issue. They heard a bunch of petitioners who voiced their concern about the domicile restrictions for medical admissions in the state. Along with this, the petitioners have also challenged the rules under the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admissions and Fees) Act, 2015, which were introduced in August 2016.

The petition and its verdict

The petition was filed by Mahatma Gandhi Vidya Mandir that challenged a newly emerged rule. This new rule relating to the NEET Exam required students to have a domicile certificate or to have a passing certificate of the secondary and higher secondary board level examination from Maharashtra. This new restrictive rule was imposed after The Association of Private Unaided Medical & Dental Colleges, along with a petition by a medical aspirant, Lubna Ahmed was filed.

“We are accountable to students of Maharashtra who are prevented from taking admissions in other states. We cannot reduce their pie further,” said Acting Advocate General Rohit Deo. He also argued that “Domicile is required if the student has not passed Class X here. There are not even 0.1 per cent such cases in Maharashtra according to what we have found out.”

The HC had earlier dictated the State and Education authorities to create a list of candidates who successfully qualify the NEET Exam, with respect to the seats in private medical colleges under NEET Maharashtra on All India basis. After all the past and ongoing hearings, the Bombay HC gives its final answer. The assigned bench of judges directed the state government to prepare two separate NEET Maharashtra selection lists for students- an All-India Merit List and a list of students with State Domicile.

NEET Seat AllotmentNEET  Cut Off

Previously, on August 30, 2016, the HC had put a stay on the Government Resolution that made it mandatory for all deemed universities/ colleges under NEET Maharashtra to follow the NEET Merit List to admit students. It said that the deemed universities under NEET Maharashtra can follow their own admission procedure, and do not need to adhere to any centralized process.

The order of the HC about deemed universities under NEET Maharashtra conducting their own admission procedures was filed under the Writ Petition No. 999512016 & 1001 612016 (Mumbai) and No. 9108/2016 (Aurangabad). Along with this, the Maharashtra Government submitted three Special Petitions (No.2655812016, 2657212016 & 2656712016) in the Supreme Court against the HC order.

For the NEET Maharashtra centralized admission process, about 20,000 candidates have registered for 1,675 seats in the deemed universities of Maharashtra. With the emerging issue about the domicile restrictions in the state, further hearings may be called.

About the NEET Exam

The NEET Exam or the NEET-UG is a gateway to many medical courses and colleges across India for graduation. This includes the medical courses (MBBS), Dental courses (BDS) or the post-graduate courses (MD/MS) in government and private colleges in the country. These tests are conducted by the Central Board of Secondary Education (CBSE) each year to select the students with best NEET Scores.

We all know that the All India Pre-Medical Test or the AIPMT has been replaced by the NEET Exam. All the individual MBBS Exams will now be conducted by the state/college themselves. However, many colleges and institutes have taken a stay order and conducted private exams to admit students in their medical and dental courses.

Along with the NEET Cutoff list, the revised NEET Answer Keys were also released. Along with the government institutes, nine private institutes have begun following the admission quotas that kept aside 85% seats for students with state domicile.

The locking and their choices for the Second Round of NEET Counsellingclosed on September 10, 2016. The NEET Seat Allotment Process was held on September 11, 2016, while the results for second round seat allotment were declared on September 12, 2016. Now, reporting at the allotted Medical/Dental college against Round 2 is scheduled to go on from September 13 to September 20, 2016. And finally, the transfer of vacant seats to State Quota will be held on September 20, 2016.

The court said that all the ongoing developments relating to the NEET domicile admissions must not hamper the interests of the students from Maharashtra who cannot take admission in other states owing to similar policies there. The final list would only be released to the public once this petition is decided. We are sure that whatever the court decides, will work for the benefit of all. They will come up with a solution that suits all.
