NEET 2016 Paper Leak Row: Supreme Court refuses to interfere

The Supreme Court of India received a plea filed by National Eligibility cum Entrance Test (NEET) Phase 2 aspirant Anshul Sharma. The plea described an alleged paper leak of the NEET Exam.  The Supreme Court of India heard the plea that was mentioned by senior advocate Sanjay Hegde before a bench of Hon’ble Chief Justice TS Thakur. It was listed for hearing before the bench of Justice AR Dave on August 10,2016.

The Supreme Court on Tuesday refused to interfere claiming it an Uttarkhand police probe.

The petitioner, Anshul Sharma, requested for a status report into the alleged NEET II Paper leak of question papers which he submitted before the court. A statement released by Vaibhav Srivastav, the advocate of this matter, said, “We have demanded for the investigation reports from the Nainital Police. If those allegations are found true, then the Supreme Court should order CBSE to conduct NEET exam again keeping in mind last year’s Tanvi Sarwal’s case.”

The Tanvi Sarwal case of 2015 was one of the milestone cases. After Tanvi filed the case regarding the leakage of question papers in Haryana, the apex court ordered the Board to conduct All India Pre-Medical/Pre-Dental Entrance Exam (AIPMT, which is now NEET) again in 2015. NEET is the central examination for admission to medical colleges in India introduced this year. The investigations concluded it to be a prima facie case, based on status reports that were submitted by the Haryana Police. The court directed the re-examination of AIPMT 2015 within a period of four months.

An arrest of five people (one from Delhi and four from Bihar) belonging to an inter-state racket was made on July 23, 2014 by the Nainital Police,just a day before the exam.

A similar case was reported some time back. It got noticed when a group of students and coaching centres raised the issue of mistakes in the question paper. As a result, the students who appeared in the exam were given two correct answers to choose from four options. And hence, there were possibilities of candidates securing 8 bonus points.

Till now, no change has been issued in the NEET 2016 process and NEET 2016 Results and NEET 2016 Counselling is expected to undergo as scheduled. Recentlly CBSE released NEET 2016 OMR Key and NEET 2016 Answer Key with an option to challenge the provided answers. There were also reports of alleged mistakes in the paper. But till now, CBSE has not announced anything officially in the matter. 

What CBSE says ?

The Central Board of Secondary Examination(CBSE) denied all the allegations and emphasized that they were all false. The CBSE Counsel informed the court that it had received a list of question papers that the Uttarakhand Police unearthed during their investigation, shortly after the second phase of NEET exam on July 24,2016. CBSE also found that the seized question papers were entirely different from the original question paper of NEET 2016.

In a statement by CBSE, it said, “it was an attempt made by some unscrupulous elements to cheat the candidates on false promises."

The Supreme Court Verdict

The Supreme Court on August 9, 2016 denied to intervene in the NEET 2016 Paper leak case. However, the bench comprising of Justice AR Dave and Justice L. Nageswara Rao permited the petitioner, Anshul Sharma, to approach the Uttarakhand High Court if the need arises in future. The petitioner was also given an option to withdraw his petition before the apex court. The bench also added that,“Courts cannot monitor this. Courts are not meant for this, SSP (Haldwani) and others are looking into the matter and let them do the investigation”.
