Australia Student Visa Appeals Go Paper Only at ART

Australia’s Administrative Review Tribunal has ended oral hearings for most Student Visa refusal appeals. The shift hits Indian applicants stuck in a record 54,176-case backlog at the ART. The tribunal confirmed the paper-only route from 18 May 2026 under new migration regulations. Median wait for a Subclass 500 refusal review now runs 68 weeks.

Indian students hold the largest share of pending Student Visa appeals, tied to a 31.5% refusal rate in 2025 across 47,456 Indian applications.
Applicants file all evidence in writing, with no chance to answer tribunal questions face-to-face for standard Subclass 500 refusals.
The tribunal is 97.9 staff short of its 430 full-time target, and Student Visa cases fill more than a third of its workload.

The change flows from the Migration Amendment (Administrative Review of Student Visa Refusal Decisions) Regulations 2026. It is designed to clear a backlog that stretches many appeals past the two-year mark.

Note: Paper-only decisions for student reviews commenced on 18 May 2026. Pending student appeal files sit in the mid 50,000s, with the tribunal clearing roughly 1,200 to 1,500 cases a month, so the queue shrinks slowly even as new appeals keep arriving.

The Administrative Review Tribunal now decides most Student Visa Subclass 500 refusal reviews on the written file alone. Oral hearings, which let applicants meet a tribunal member and answer live questions, are gone by default. Applicants receive a written invitation under section 367F to submit additional documents.

The response window is tight and non-negotiable.

What it means for Indian Students: A weak Statement of Purpose or a thin funds record can no longer be rescued by explaining the gap in a hearing. Your first written submission is now your entire case.

Note: The money side has hardened too. Most migration review applications now cost AUD 3,580, with a 50% hardship reduction to AUD 1,790 available before the deadline, a 50% refund if the appeal succeeds, and fees indexed every 1 July. The ART notes increased application fees now apply.

Why the Student Visa Backlog Hit 54,176 Cases

Two forces built the pile-up. First, refusals climbed after India was moved to Evidence Level 3, the highest-risk category, on 8 January 2026. Second, ART staffing lagged the tribunal’s own target by 97.9 full-time roles as of late 2025.

Student Visa cases now sit at the top of the caseload.

Note: Paper reviews do not add tribunal capacity; they cut the time each case takes. Indians who submit a complete file first time will move fastest, while incomplete files may still slip beyond a year.

The tribunal kept oral hearings for refusals that turn on personal credibility or health. The written-only rule does not apply to Public Interest Criteria that need direct questioning.

Most Indian Subclass 500 refusals are booked under the Genuine Student requirement, which does not fall in this list. Those appeals will now be decided on paper alone.

How Should Indian Students File a Written Appeal?

The clock starts the day the refusal letter arrives. Onshore applicants have 21 days to lodge with the ART, while offshore applicants get 28 days. The application fee sits at A$3,496 (about ₹1.9 lakh) for a merits review, with a 50% concession for hardship cases. Once lodged, prepare the full evidence pack before the section 367F invitation lands.

Files under 20 MB can go through the ART online portal. Larger evidence packs need a courier submission to the tribunal registry in the state where you last held or applied for the visa.

Important Distinction: A paper review is not a fresh application. The tribunal only looks at the grounds the delegate used to refuse you. New study plans or a switched course will not help unless they answer the original refusal reason.

Indian applicants waiting on a February or July 2027 intake should assume the review will not close before their course start date. The tribunal has warned that even the 68-week median masks longer waits for complex files.

Action Plan for Indian Applicants

Read the refusal letter within 48 hours and diarise the 21 or 28-day lodgement deadline.
Pay the A$3,496 ART fee or lodge a hardship waiver on the same day you file.
Draft the rewritten SOP and gather financial proof within the first two weeks.
Submit the full evidence pack with the initial application, not after the 367F invitation.
Keep the CoE alive by paying tuition instalments while the appeal runs.
