The High Court has issued a notice to the State Government of Delhi on November 10, 2020, regarding a petition challenging the validity of the admission guidelines for Class 11th.

The Delhi Government’s admission guidelines specify that the maximum age for admission to Class 11th will be 17 years with 1 year of relaxation.

However, no admission will be provided to a student seeking admission after a gap of one year.

On seeking the response of the Directorate of Education and Government Boys Senior Secondary School, a single-judge bench of Justice Jayant Nath slated the matter for further hearing on December 18, 2020.

Ravish Kumar Singh, a student who could not study for 1 year in 2019-2020, filed the petition against Delhi Government admission guidelines.

Advocate Ashok Agarwal filed the appeal to the Delhi High Court seeking withdrawal of the admission circular dated October 16, 2020.

According to Ravi, he was 17 years and 1 month old as of March 31, 2020, and he went to his hometown in Bihar to take care of his ailing mother because of which he could not study during the 2019-20 academic year.

The plea lays down the maximum age limit for admission as arbitrary, illegal, discriminatory, and violating the Indian Constitution Articles 14, 21, and 21A.

The plea further mentioned that the new guidelines are in conflict with the provisions of the Delhi School Education Act, 1973.

Advocate Ashok Agarwal appeared for the petitioner to argue that there is no discretion for condoning the gap year even in genuine and bonafide cases.

Hence the admission guidelines are arbitrary, discriminatory, unconstitutional, and irrational, Ashok Agarwal stated.

He submitted that there cannot be a maximum age limit for education legally. Therefore, stipulating 17 years as the maximum age limit for admission to Class 11th is discriminatory, arbitrary, and hit by Articles 14 & 21 of the Constitution of India.

The plea also seeks directions from the respondents to grant admission to the petitioner in Class 11th for the academic session 2020-21.

Advocate Ashok appealed for admission of Ravish in said school or any of the respondent Government schools near his residence.
