The Supreme Court on August 19, 2020 issued notice to the Indian Certificate of Secondary Education (ICSE) in a plea seeking the opportunity of re-assesment or promotion to the students who have failed the 9th and 11th classes by adopting the option given by CBSE in view of COVID-19 Pandemic.
The plea is filed by a petitioner of class 11th through Advocate Alakh Alok Srivastava. The notice issued by the Bench of Justice AM Khanwilkar, Dinesh Maheshwari and Sanjiv Khanna.
As per the report, the plea states that if the ICSE does not adopt the resolution adopted by CBSE on May 13, then many 9th and 11th standard students will be deprived of right to equality as guaranteed under Article 14 of the Constitution.
On May 13, 2020, CBSE decided to provide an opportunity for the failed students to appear in a school-based test again as a one-time measure.
It was also decided that the opportunity will be extended to students irrespective of whether or not their examinations got completed and the exam results are released.
During the earlier hearing in the matter in SC, CISCE cancelled pending ICSE Board Exams and ISC board exams due to the COVID-19 situation. The Board also adopted an alternative assessment scheme to release ICSE and ISC results 2020.
