The UK Home Office has confirmed a fix to its Graduate route dependant rule. It now takes effect on August 3, 2026, not July 30 as first cited. Indian Graduate visa parents may add UK-born babies as new dependants for the first time. The change sits in Statement of Changes HC 259, published on July 9, 2026.

  • UK-born babies of Graduate parents may now apply as dependants. Filing must happen from inside the UK.
  • The fee is £937 per child. The Immigration Health Surcharge costs £776 per year for under-18s.
  • The child’s permission ends when the Graduate parent’s route ends. Both windows must align on the same day.

The old rule left UK-born babies of Graduate parents without formal status. The Home Office fix follows months of pressure from immigration lawyers.

What Changes for Graduate Route Parents on August 3

The updated rule expands who counts as a Graduate Route dependant. Earlier, only a child already on a UK dependant visa qualified. From August 3, 2026, UK-born babies of Graduate parents may apply too.

The dependant application must be filed from inside the UK. Overseas relatives cannot join a Graduate parent through this route. The rule sits inside Statement of Changes HC 259. The Home Office published HC 259 on July 9, 2026. No path existed for a baby born after the Student visa ended. That gap has now closed.

Key Insight: The four-day slip from July 30 to August 3, 2026 matters. Any dependant application filed before that Monday will be rejected as premature.

Who Benefits Among Indian Graduate Route Holders

Indian nationals lead the Graduate route grant list each year. Many switch to a Skilled Worker sponsor before the two-year window ends. A UK-born baby now holds clean status through the parent’s route.

Two Indian cohorts gain the most from the fix:

  • New parents mid-Graduate route: babies born during the two-year post-study window.
  • PhD graduates on the three-year route: babies born during the longer stay window.
  • Couples where one parent is on the Graduate route: the UK-born baby can now align with the Graduate parent.

Overseas relatives still cannot join via the Graduate route. Spouses and children outside the UK are not covered by this rule.

How Much Does the Dependant Application Cost?

The Home Office charges £937 per child for a Graduate dependant application. The Immigration Health Surcharge adds £776 per year for under-18 dependants. A two-year IHS bill for a baby comes to £1,552. At ₹128 per GBP, the total per baby lands at ₹3,18,592. That was the interbank rate in late July 2026.

Cost line Amount (GBP) Amount (INR)
Application fee per child £937 ₹1,19,936
IHS per year for under-18 £776 ₹99,328
Two-year IHS total £1,552 ₹1,98,656
Combined fee plus two-year IHS £2,489 ₹3,18,592

This bill runs on top of the parent’s own UK student visa fees already paid for the Graduate route.

How Do Indian Parents Apply for the Dependant Visa?

The Home Office runs the application online. Every step must be finished inside the UK. Decisions typically arrive within eight weeks of biometrics.

  1. Confirm the parent holds valid Graduate route permission on August 3, 2026 or later.
  2. Register the birth in the UK and collect the official birth certificate.
  3. Complete the online Graduate dependant application form on gov.uk.
  4. Pay the £937 fee and the £776 IHS per year at submission.
  5. Book a biometrics slot and upload supporting documents.
  6. Wait for the Home Office decision within the eight-week window.

What it means for Indian Students: The child’s stay ends on the earlier parent expiry date. That matters if both parents hold different UK visas. Plan the switch to a longer route in time.

What the Rule Does Not Change

The fix is narrow by design. It does not stretch the Graduate parent’s own stay. It does not open the route to overseas family. The route also stays off the settlement track.

  • Graduate route time still does not count toward the 5-year Skilled Worker settlement.
  • It may count toward 10-year long residence ILR under separate rules.
  • Adult dependants such as spouses need their own qualifying visa.

The Home Office calls it a compassionate patch, not a redesign.

Indian Graduate parents now have a clean status path for UK-born babies. The change goes live on August 3, 2026 under HC 259. The dependant fee stays at £937 per child plus IHS. The Graduate route still runs for two years, or three for PhDs.

Action Plan for New Parents on the Graduate Route

  1. Check the parent’s Graduate Route expiry date and any switch dates.
  2. Register the UK birth and secure the official birth certificate.
  3. Budget £937 plus the IHS for the full alignment window.
  4. File the dependant application from August 3, 2026 onward.
  5. Submit biometrics and track the decision within eight weeks.

Next Date for New Parents on the Graduate Route: The rule goes live on Monday, August 3, 2026. Dependant applications for UK-born babies may be filed from that date onward.
